Evaya Organics 25-YEAR LIMITED Mattress Warranty

Congratulations on purchasing your new mattress, manufactured by Jeffco Fibres on behalf of Evaya Organics, in either our Massachusetts or Connecticut factories. We wish you many years of comfort and luxurious sleep. 

All our mattresses are manufactured in the U.S.A. using domestic and imported materials. 

We take pride in our commitment to product quality and a customer focused approach which is reflected in every mattress that carries the Evaya Organics name.  

Warranties do not need to be complicated. They convey a promise and promises are simple. In the following text, we have detailed what the Limited Warranty covers, what it does not cover, and what you need to do to help us fulfill our promise to you and your responsibilities. What is covered in Evaya’s, Inc. 25-Year Limited Warranty? 

What it means- Your new mattress is covered by a 10-Year Limited Warranty from the date of your purchase as detailed below. For the first 10 years your mattress has a full replacement warranty based on manufacturers defects as outlined below. The next 15 years is a limited warranty that will be pro-rated based on years of use. 

Defects covered under the Limited Warranty: 

  • Manufacturing defects in the mattress materials causing the mattress to have a visible indentation greater than 1.5 inches that is not a result of sagging caused by an improper foundation, bed frame or body fluids. 
  • A split or crack in the foam materials that occurs despite normal use and proper care of the mattress. 
  • Tearing or splitting of the outer fabric that occurs despite normal usage and proper care. 

Issues not covered under the 25-Year Limited Warranty: 

  • Comfort or personal preference. 
  • Visible indentation less than 1.5 inches. Some settling of mattress materials will occur over time as the mattress conforms to your body and should be considered normal.
  • Physical abuse or damage to the structure and/or cover material including but not limited to cuts, tears, burns, stains or liquid damage caused by such abuse. Note, folding the mattress other than for use on an adjustable base is considered abuse.  
  • Mold or Mildew. Placing your mattress directly on a carpeted surface or in a damp environment may cause mold or mildew in the mattress.  
  • Slight tailoring imperfections such as rounded corners, or the mattress seam not being completely straight due to the handcrafted nature of this product. 
  • Improper cleaning of the mattress. The mattress should be spot cleaned only, using a mild detergent.
  • Insect infestation of any kind. 

Softening of the raw materials used in the mattress: 

Organic and natural materials will soften over time. A normal increase in the softness is normal with use. This is not covered under this Limited Warranty.  There may be instances where these materials soften more than would be considered normal, but if there is a visual sag greater than 1.5” it could be considered a manufacturing defect.  If you suspect such a situation has occurred, please contact us, and we will work with you to determine whether your problem would be considered a manufacturing defect. 

Who is covered by a Evaya’s 25-Year Limited Warranty? 

The original owner/purchaser- All Evaya’s warranties are valid only for the original owner/purchaser of the product.  An “original owner/purchaser,” for the purposes of this Limited Warranty, is an individual or entity who purchases the product directly from Evaya or an authorized retailer of Evaya with the intent to use the product for personal consumer use and not for commercial or industrial use and not with the intent to resell the product. All Evaya Mattress warranties extend from the original purchase date of the original product purchased. The Limited Warranty period starts from the date of sale to the original owner/purchaser.  All warranties are valid only for the period of time the Mattress is owned by the original owner/purchaser of the mattress.  The Limited Warranty is non-transferrable. Please keep a copy of your receipt from an authorized Evaya seller as proof of purchase in order to make a warranty claim. 

How does the Evaya 25-Year Limited Warranty work? 

If you suspect your mattress has a defect covered under this Limited Warranty, please contact us at support@evayaorganics.com. You will be asked for a copy of the proof of purchase, along with photographs of the mattress, foundation, frame, and law tags to help us determine the nature of the problem. If a manufacturing defect exists, as covered under this Limited Warranty, Evaya reserves the right to repair or replace the mattress.  If a replacement mattress is sent during the first year of ownership, Evaya will pay to drop ship the replacement.  No new warranty is provided with a replacement product. The warranty for the replacement product runs from the date of original purchase of the replaced product. The purchaser will be responsible for properly disposing of any defective mattress and any applicable transportation charges.   Note – If the original model is no longer manufactured, Evaya may substitute a mattress of equal or higher quality. One warranty replacement per purchase. 

Evaya 25-Year Limited Warranty Customer Responsibility: 

The mattress is designed to be placed on a flat, solid surface that is structurally capable of supporting the weight of the mattress and users. Examples of acceptable surfaces include: 1) A mattress foundation in good condition with no open spaces being more than 4” apart, 2) A platform bed with slats no greater than 3 inches apart and or flat ridged slats without flex. Additionally, if the foundation or platform bed is placed on a frame or other support surface, that too should be structurally capable of supporting the mattress and user. Full, Queen, and King foundations need to be supported in the center with legs as well as along the edges of the mattress, foundation and frame. Failure to properly support the mattress will invalidate the Limited Warranty. THEREFORE, IF PURCHASER USES INAPPROPRIATE FOUNDATIONS, BOX SPRINGS, ADJUSTABLE BED BASES, PLATFORM OR BED FRAMES WITH THE MATTRESS, SUCH USE WILL VOID THIS LIMITED WARRANTY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 

The mattress must be un-boxed and opened within 60 days of receipt, or the Limited Warranty will be invalidated.

Evaya Organics 1-YEAR LIMITED WARRANTY

Evaya Organics warrants that Pillows and Top of bed and Wood products will be free from defects in material and workmanship as described in this warranty (hereinafter referred to as the “Limited Warranty”).

 

Conditions of the 1-Year Limited Warranty? 

This 1-year Limited Warranty starts on the date of purchase and is valid only in connection with the original purchase of new products directly from Evaya Organics or an authorized retailer of Evaya Organics and extends from the original purchase date of the original product purchased as detailed below.  If a defect in material or manufacturing occurs during the first year, subject to the limitations described in this Limited Warranty, Evaya Organics will repair or replace (at Evaya Organics’ option) the defective item. If replacement is required, Evaya Organics may substitute materials of equal or higher quality when the like components are not available. If defects such as splitting or cracking occur during normal usage and proper handling, we will, at our discretion, replace the item. The consumer is responsible for shipping charges. No new warranty is provided with a replacement product. The warranty for the replacement product runs from the date of original purchase of the replaced product.

Issues not covered by the 1-Year Limited Warranty: 

  • Comfort preference.
  • Transportation charges for return and reshipping when necessary.
  • Abuse or unsanitary conditions

Please note that Evaya Organics reserves the right to refuse service and invalidate this Warranty when the item is found to be in unsanitary condition, or when product failure is due to causes other than defective material and/or workmanship.

In the case of our pillow products, this warranty does not include a normal increase in softness of the material.

Who is covered by a Evaya Organics 1-Year Limited Warranty?

Legal Stuff 

THE FOREGOING LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE Evaya’s OBLIGATION UNDER THIS WARRANTY IS  STRICTLY AND EXCLUSIVELY LIMITED TO THE REPAIR OR REPLACEMENT OF THE MATTRESS OR COMPONENT PARTS AS DESCRIBED HEREIN AND  EVAYA DOES NOT ASSUME OR AUTHORIZE ANYONE TO ASSUME FOR IT ANY OTHER OBLIGATION. EVAYA ASSUMES NO RESPONSIBILITY, AND SHALL NOT BE LIABLE TO ANY PARTY, FOR INCIDENTAL, CONSEQUENTIAL, PUNATIVE OR OTHER DAMAGES INCLUDING, BUT  NOT LIMITED TO LOSS OR DAMAGE TO PROPERTY, LOSS OF PROFITS OR REVENUE, LOSS OF TIME, OR INCONVENIENCE. EVAYA DOES NOT WARRANT THAT THIS PRODUCT IS SUITABLE FOR ANY PERSON’S MEDICAL CONDITION. THIS LIMITED WARRANTY REPRESENTS THE ENTIRE AGREEMENT BETWEEN EVAYA AND THE PURCHASER WITH RESPECT EVAYA’S WARRANTY OBLIGATIONS AND  SUPERSEDES ALL PRIOR OR CONTEMPORANEOUS ORAL OR WRITTEN COMMUNICATIONS, REPRESENTATIONS, UNDERSTANDS, OR AGREEMENTS  RELATING TO THIS SUBJECT.  

Some States do not allow limitations on how long an implied warranty lasts, so this limitation may not apply. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Evaya does not authorize any person to create for it any other obligation or ability in connection with this warranty.
